{"id":692,"date":"2012-11-07T00:54:17","date_gmt":"2012-11-07T00:54:17","guid":{"rendered":"http:\/\/my-brains.co.uk\/jackross\/jack-ross-news\/?p=692"},"modified":"2012-11-07T00:54:17","modified_gmt":"2012-11-07T00:54:17","slug":"real-time-information-rti-are-you-ready","status":"publish","type":"post","link":"http:\/\/my-brains.co.uk\/jackross\/real-time-information-rti-are-you-ready\/","title":{"rendered":"Real Time Information (RTI) \u2013 are you ready?"},"content":{"rendered":"<p><strong>Real Time Information (RTI) is a new system being introduced in April 2013 by HM Revenue &amp; Customs (HMRC) for the reporting of payroll information, which will effectively require employers and pension providers to provide detailed information to HMRC every time employees are paid rather than through the year end return. Under RTI, the employer will be required to submit information; including details of earnings and the tax and NIC deducted whenever a payment is made to an employee. <\/strong><\/p>\n<p>With the implementation of RTI becoming mandatory without exception between April 2013 and October 2013, RTI will be the biggest single overhaul to the payroll since PAYE was first introduced in 1944. A pilot of the RTI scheme began in April 2012 allowing HMRC to test the system and resolve any problems prior to the mandatory implementation date.<\/p>\n<p><strong>RTI will link with the Universal Credit<\/strong><\/p>\n<p>One of the main reasons that the RTI system is being introduced so promptly is as a result of the pending introduction of the Universal Credit benefit system from October 2013, which is intended to simplify the system for making benefit payments to the unemployed or low earners.\u00a0 Under the new Universal Credit system and using the RTI data submitted monthly to HMRC, it will be possible for the benefit payments to be calculated and adjusted for claimants based on their earnings each month, rather than the current system which often leads to errors and abuse.\u00a0 It is estimated that the new Universal Credit system will reduce fraud and error by \u00a32 billion over five years.\u00a0 Many commentators believe that this move is long overdue, whilst sceptics suggest this will increase the administrative burden placed on employers and further push the UK towards a \u2018Big Brother\u2019 state.<\/p>\n<p><strong>HMRC increases its monitoring<\/strong><\/p>\n<p>Not to be fooled, RTI will also make the monitoring of PAYE much easier for HMRC as the information will be up to date and accurate.\u00a0 This will allow HMRC to more promptly identify and pursue those businesses that have unpaid PAYE during the year, avoid recalculations at the end of the tax year and permit HMRC to issue penalties for late payment as soon as the employer becomes liable for one.<\/p>\n<p><strong>Main changes<\/strong><\/p>\n<p>Undoubtedly RTI will have an impact on the way information is collated and communicated with HMRC.\u00a0 The main changes and challenges are:<\/p>\n<ul>\n<li>Firstly, all employee data sent to HMRC must pass a validation check against the HMRC database.\u00a0 Referred to as the Employer Alignment Submission (EAS) or a first Full Payment Submission (FPS), this will be the first step to joining RTI and will allow HMRC to update their database with the details from this submission.\u00a0 Employers will be contacted to notify them when and how this should be completed.\u00a0 This submission will need to include starters and leavers in the year, not just those under current employment. Details including the full employee name, postal address, date of birth and national insurance number will be required.<\/li>\n<\/ul>\n<ul>\n<li>Under RTI you will not be able to process any pay for new employees that fail the validation procedure with HMRC.\u00a0 Therefore, it is extremely important that the information provided to your payroll bureau is accurate.\u00a0 Particular issues identified for employers include the use of shortened names, such as \u2018Chris\u2019 rather than \u2018Christopher\u2019, and employees that have a default or \u2018made up\u2019 date of birth making them in excess of 100 years old.\u00a0 The days of being able to submit information to HMRC about employees with slight inaccuracies in order to ensure that the full pay and deductions can be calculated will be eliminated.<\/li>\n<\/ul>\n<ul>\n<li>Employers will be required to file the full pay, tax and national insurance information of their employees to HMRC before the employees have been paid.<\/li>\n<\/ul>\n<ul>\n<li>The submission of year end forms including a P14 for each employee and the P35 employer summary and declaration will be abolished.\u00a0 Under the rules of RTI, the information previously requested at the end of year will effectively be supplied by the employer on a month by month basis.\u00a0 The employer will, however, need to notify HMRC that it is the final payroll submission of the tax year, so this will need to form part of the year end procedure.\u00a0 Whilst employers will still need to produce and keep forms P45 for leavers and form P46 for starters, there will not be a requirement to send these to HMRC once RTI is in place.<\/li>\n<\/ul>\n<p><strong>Forms P60 and P11D<\/strong><\/p>\n<p>There are no changes with respect to form P60 that will still need to be provided to each employee at the end of each tax year. \u00a0The form P11D which is used to report benefits and expenses for an employee will also continue to be reported separately from the RTI, despite being recognised by HMRC as an area that continues to cause significant problems for them, as well as for employees and employers in the operation of PAYE.\u00a0 Given that the RTI is being partially introduced by HMRC to help combat the issues caused by operating PAYE codes erroneously on old data, it is disappointing that a new system for dealing with P11D benefits has not been given more thought as part of this initiative.<\/p>\n<p><strong>Be prepared<\/strong><\/p>\n<p>It is clear that many employers are not prepared for the RTI changes whatsoever.\u00a0 Indeed, the short deadline for implementation will be a major concern for employers who operate their own payroll and who may not fully understand the changes.\u00a0 The developers of payroll software will also be endeavouring to ensure all the necessary changes to their product can be made in time.\u00a0 Those employers with nine or fewer employees will be able to use the free HMRC software package, which will be compatible with the requirements of RTI.\u00a0 Unfortunately the RTI system will be enforced by further penalties, which have now become a customary feature of the UK tax system.<\/p>\n<p>Given the mandatory nature of the RTI scheme, some employers will be keen to start the process as soon as possible.\u00a0 The final deadline to volunteer for the pilot is 30 November 2012 for employers using HMRC\u2019s Basic PAYE Tools.\u00a0 For employers not using the HMRC Basic PAYE Tools, the final deadline to volunteer is 31 December 2012.\u00a0 To ensure the smooth transition over to RTI, HMRC will be looking to include a wide variety of employers covering a diverse range of business types and sizes, and they will also need to ensure the employer can use software compatible with reporting under RTI.\u00a0 HMRC will review all applications to join the pilot against these criteria and advise if employers are eligible to join the pilot scheme.<\/p>\n<p><strong>Make sure you seek advice<\/strong><\/p>\n<p>We would recommend that you speak to your payroll administrator and software provider to ensure that your business is fully prepared for the changes afoot.\u00a0 For guidance on the implementation of RTI, please do not hesitate to contact us.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Real Time Information (RTI) is a new system being introduced in April 2013 by HM Revenue &amp; Customs (HMRC) for the reporting of payroll information, which will effectively require employers and pension providers to provide detailed information to HMRC every time employees are paid rather than through the year end return.
